自民党の憲法改正草案では憲法13条の表現が変わっています。

すべて国民は、「個人として」尊重される権利は「公共の福祉」に反しない限り最大限尊重される。

⚠️ 改憲草案

全て国民は、「人として」尊重される権利は「公益及び公の秩序」に反しない限り尊重される。

❓ 何が変わる？

①個人として → 人として

➡️ 個人の尊重ではなく、社会の中の「人」としての位置づけへ

⚠️ 個人の自由が制限される可能性があると指摘されています。

②公共の福祉 → 公益・公の秩序

現行憲法➡️ 人権同士が衝突する場合のみ制限

改憲草案➡️ 国益や秩序を理由に人権が制限される可能性

📜 What if the word “individual” disappears

from Japan’s Constitution?

Japan’s ruling party proposed a draft amendment

that changes the wording of Article 13.

⭐️ Current Constitution

“All people shall be respected as individuals.”

Rights to life, liberty and happiness are protected

unless they conflict with public welfare.

⚠️ Proposed Draft

“All people shall be respected as persons.”

Rights are protected

as long as they do not conflict with

public interest and public order.

❓ Why does this matter?

①“Individuals” → “Persons”

Critics argue this may weaken the protection of people as individuals.

②“Public welfare” → “Public interest / public order”

Currently, rights are mainly limited when they conflict with other people’s rights.

The draft could allow restrictions

based on national interest or public order.
